Estate Planning

Before any Will, Trust, beneficiary designation for an insurance policy or 401(k) plan or other document to transfer wealth can be prepared , whether to take effect during your lifetime or at death, it is essential that an estate plan be prepared. Similar to construction of a house or building, the first step is to prepare a plan.

With your input and assistance from other professionals that you wish to have participate, such as your accountant, insurance agent, or financial advisor a comprehensive estate plan can be developed for you. The scope of the plan and the role each of your advisors plays is determined based on your needs and desires and the size and complexity of your estate plan.

Trusts and Estate (Probate) Litigation

In addition to assisting clients with proper planning and administration of estate and trusts, our attorneys are experienced in litigating estate, probate and trust issues. Representation is provided for beneficiaries as well as Personal Representatives, Executors, and Trustees.

The issues involved in estate or trust matters are very different than general civil litigation and Probate Court Rules are often unfamiliar to general civil litigations. Many estate attorneys have little or no experience in litigation matters.

Disputes in estate or trust administration encompass issues about the validity of Will or trust documents and the legal capacity of the decedent at the time the document was executed, or assets, were transferred. Issue often arise about the handling of affairs under a power of attorney, will interpretations, title to assets as well as issues regarding proper administration of an estate or trust.

We represent institutional and individual fiduciaries as well as beneficiaries or others with claims against an estate or trust in both Pennsylvania and Florida.
